In the wake of the "Atlantic Revolutions" of the years 1770–1800, exile movements grew in importance, and political motives became their prominent causes. In the Europe of the Congress of Vienna, exile became a rite of passage for patriots and liberals fighting for the building of their nation-states. Through the 19th century, new legislations were adopted to rule on the status of "refugees", an administrative category that slowly emerged. Nonetheless, the beginning of the 20th century profoundly transformed political exile, at a time when wars forced millions of Europeans to be displaced, and when several regimes deprived large numbers of their citizens in exile of their nationality.

Scandinavian or Nordic law constitutes a distinct legal system. The historical origins of this legal tradition can be attributed to the frequent border changes between the individual countries and the evolving personal unions that interconnected them throughout the centuries. This article provides an overview of Nordic law, including its legal system, jurisprudence, distinctiveness, and unique features. It also provides specific examples that highlight the peculiarities of the Scandinavian legal system.

From the mid-18th century, there was an increasing trend to regulate larger domains of law, such as civil or criminal law, through the implementation of codifications. In Europe, three significant waves of codification emerged: the wave of natural law (around 1800), the wave of pandectics (around 1900), and the subsequent wave within the "socialist legal system." Alongside these developments, this article also explores the movements of decodification and recodification that took place after 1945.

This contribution offers a broad overview of the common themes that linked together the royal and imperial courts of Europe in the pre-modern world. In particular it demonstrates that court cultures were spaces both of emerging national identities but also the preservation and cultivation of more cosmopolitan values. The first section examines the court itself, its structure and hierarchy, as a blending space for elites and artists. Then the contribution examines the concepts defining royal dynasties, the glue that held court culture together, and how these concepts changed, especially through cultural transfer.

The German legal system refers to the continental European, German-speaking, and typically codified law dominated by the private-law systems of Austria, Germany, and Switzerland. Its roots lie in Roman-German law, which influenced other legal systems beyond the borders of Europe as a result of 19th-century jurisprudence. The interaction between the codifications of the German legal system both brings about and maintains their connectedness. Their function as foundations or models for the legal systems of other countries lends them an importance that underscores the global significance of the German legal system.

The new state's norms and values were primarily established in the founding years of the Turkish Republic. Kemalism was the driving force behind Turkey's nationalization and state-building process. It was the product and further development of a course of nationalization that had its roots in the Ottoman Empire and the ideas and utopias originating in Europe. Atatürk and the Turkish state elite formed their own national concepts from these ideas and translated them in Kemalism into political action. Kemalism was intended to accomplish the transformation from empire to republic, replacing Islam as the "social glue" with a robust Turkish nationalism.

Empires and "composite states" were pre-modern dominions characterised by a high degree of political, administrative, economic, judicial and cultural heterogeneity. This was the rule rather than the exception in early modern Europe. However, scholarship has so far tended to consider these two forms of rule separately. In this context, the cases of Spain and Sweden – both pre-modern states displaying a "composite" character and imperial tendencies – can serve to exemplify the plurality of guises under which such dominions might appear. In so doing, they underscore the need for transregional and transnational approaches capable of identifying the reciprocal processes of interaction, transfer and reception at play here.

This article examines a variety of international social movements before 1945 and seeks to encourage a more deep-rooted historical transnational study of social movement in global perspective ranging from the labour movement and social reform movements to religious movements, the temperance movement, moral movements, youth movements, peace movements, nationalist and fascist movements, pan-movements, national liberation movements, women's movements, LGBTQ movements, movements for abolition and racial equality, indigenous rights movements and environmental movements. It argues that more attention to right-wing social movements is needed as are more intersectional approaches that can use a variety of useful theoretical approaches to the study of social movements.

Imperien und "composite states" waren vormoderne Herrschaftsgebilde, die in politischer, administrativer, wirtschaftlicher, rechtlicher und kultureller Hinsicht durch ein hohes Maß an Heterogenität geprägt waren. Dies stellte im Europa der Frühen Neuzeit keineswegs eine Ausnahme, sondern eher den Normalfall dar. Allerdings werden diese beiden Herrschaftsformen in der Forschung bislang überwiegend getrennt betrachtet. Die Fallbeispiele Schweden und Spanien, beides vormoderne Staatswesen mit einem "zusammengesetzten" Charakter und imperialen Tendenzen, verdeutlichen in diesem Zusammenhang mustergültig die Pluralität der diesbezüglichen Erscheinungsformen und die damit einhergehende Notwendigkeit transregionaler und -nationaler Betrachtungsweisen, die die reziproken Interaktions-, Transfer- und Rezeptionsprozesse zu erfassen in der Lage sind.

Bis Ende des 17. Jahrhunderts stand die Organisation der Orthodoxie im Einklang mit den alten Kanones aus dem byzantinischen Zeitalter. Auch nach der osmanischen Eroberung änderte sich diesbezüglich wenig. In Russland blieb es weiterhin bei dem traditionellen byzantinischen Verhältnis zwischen Staat und Kirche und somit auch bei den Reibungsflächen zwischen den weltlichen Fürsten (ab 1547 Zaren) sowie den kirchlichen Metropoliten (zwischen 1326–1589) und Patriarchen in Moskau (1589–1700). Aus diesem Konflikt ging das Zarentum als Sieger hervor; Peter I. der Große (1672–1725) schaffte das Patriarchat ab und ordnete im Jahre 1721 die Einsetzung eines Heiligen Synods an, der in die Staatsverwaltung integriert wurde. Damit übernahm Peter der Große für den Synod der Russisch-Orthodoxen Kirche die Konsistorialverfassung der protestantischen Landeskirchen. Die sogenannte "petrinische Reform" wurde während des 19. Jahrhunderts in den mehrheitlich orthodoxen Staaten Südosteuropas eingeführt. Der Wiener Hof etablierte auch in den multiethnischen (serbischen und rumänischen) orthodoxen Kirchen der Habsburgermonarchie Konsistorien. Nach dem österreichisch-ungarischen Ausgleich (1867) führte Andrei von Șaguna (1809–1873), der Metropolit von Sibiu (dt. Hermannstadt), in der rumänischen Kirche eine einzigartige Verfassungsreform durch, deren Prinzipien auch von der serbischen Metropolie von Karlowitz übernommen wurden.

The article describes missionary processes in the (early) modern period and analyzes the tension that existed with colonialism. In this context, a strict distinction must be made between religious-theological and political-colonial logics and practices. The intertwining of colonial rule and ecclesiastical mission becomes apparent in the example of early modern Hispano-America, which gave rise to fierce criticism of colonialism and legal-ethical reflection. Contemporaneous missions in the Asian region (India, Japan, China, Korea) usually took place in non-colonial contexts and adapted to foreign cultures. The dual confessional mission in 19th century Africa clashed with an imperialistic European colonialism, which disappeared in the decolonization of the 20th century.

Der Beitrag beschreibt Missionsprozesse in der (Frühen) Neuzeit und analysiert das Spannungsverhältnis zum Kolonialismus. Dabei ist strikt zwischen religiös-theologischen und politisch-kolonialen Logiken und Praktiken zu unterscheiden. Am Beispiel des frühneuzeitlichen Hispano-Amerika tritt die enge Verquickung von kolonialer Herrschaft und kirchlicher Mission zu Tage, auf die scharfe Kolonialkritik und rechtlich-ethische Reflexion erfolgt. Zeitgleiche Missionsprojekte im asiatischen Raum (Indien, Japan, China, Korea) finden in der Regel in nicht-kolonialen Kontexten statt und passen sich Fremdkulturen an. Die konfessionell gedoppelte Mission im Afrika des 19. Jahrhundert trifft auf einen europäischen Kolonialismus mit imperialem Gestus, der in der Dekolonisation des 20. Jahrhundert verschwindet.

Peace processes shaped political and social transformations in pre-modern Europe on many levels. At the core of these peace processes was the negotiation and implementation of legal structures for the non-violent resolution of conflict, and these processes can be observed from the interpersonal level of social interaction up to the relationships between states. They were directly connected with core processes of the pre-modern era that affected each other: state-formation (domestic, urban and general peace), confessionalization (religious peace) and globalization (diplomacy), each with its own different forms of norm-formation and institutionalized practices, which in the event of conflict were supposed to enable communication and lead to legally defined rules. Rooted in the Christian ethics of peace and in common law, these processes were also the subject of intensive Europe-wide media reflection.

Die Unionen von Teilen der Ostkirchen mit der Kirche von Rom waren seit dem 16. Jahrhundert auf römischer Seite durch eine antireformatorische, papstzentrierte Ekklesiologie geprägt. Sie führten zu einer nachhaltigen Konfessionalisierung: Aus "Lateinern" und "Griechen" wurden "Katholiken" und "Orthodoxe". Anstelle der "unio" entstanden neue Entfremdungen und Spaltungen. Der Beitrag thematisiert das Konzil von Ferrara-Florenz (1438/1439) als Bezugspunkt der Unionsbemühungen und stellt die wichtigsten Unionen und Unionsversuche dar, u.a. die Brester Union, Unionsversuche in Siebenbürgen mit der Reformierten Kirche, die Siebenbürger Kirchenunion und Unionen pro foro interno. Aufgewiesen werden die veränderten Rezeptionsbedingungen in Ost und West heute und eine ökumenische Lösungsperspektive.

Between 1609 and 1614 the Moriscos were expelled from Spain for political and religious reasons. All Morisco communities had to leave their villages in Spain. This event mostly led them to Northern Africa. The Sa'di Kingdom of Morocco and the Ottoman provinces of Algiers and Tunis received many Moriscos, who went through different stages of social integration. Overall, the Moriscos became socially and politically assimilated into foreign groups, especially the 'ulūj. Their contribution to the economic and military development of their North African destinations was quite remarkable.

Das östliche Mitteleuropa umfasst im landläufigen Sinne die Länder Polen, Tschechien, Ungarn und die Slowakei in ihren historischen Gemeinsamkeiten und Verflechtungen. Konkret sind dies die zumindest innerhalb Europas außergewöhnliche ethnische und religiöse Vielfalt, die geopolitische Lage zwischen Deutschland und Russland, die jahrhundertelange Einbindung in imperiale Zusammenhänge und die anschließende nationalstaatliche Emanzipation sowie kulturelle Transfers und Verdichtungen. Der Begriff "Ostmitteleuropa" selbst ist umstritten, ebenso wie die Grenzen der Region, die er bezeichnet. Im weitesten Sinne werden auch die baltischen Staaten, Weißrussland und die Ukraine sowie Südosteuropa und der Balkan hinzugezählt, dazu kommen Brandenburg-Preußen und für die zweite Hälfte des 20. Jahrhunderts selbst die DDR. Ein derart weiter Begriff Ostmitteleuropas hat sich im deutschen Sprachraum jedoch nicht durchgesetzt.

This contribution offers an overview of the origin, development and persistence of Roman law from its origins in the 8th century BC to the 19th century AD. Roman law and its sources, above all the Justinianic Codification – the so called Corpus Iuris Civilis – have left an indelible imprint on the development of law in Europe and laid the foundation of many European legal systems. The role of Roman law within the legal science in the Middle Ages and the modern period will therefore also be treated here. Moreover, this article will discuss the fundamental relationship between Roman and Canon law and the reception of Roman law in many countries in Europe.

Die Schwarzmeerregion wird von den historischen Wissenschaften als eine eigenständige Geschichtsregion begriffen, die besonders durch gewaltige Migrations- und Akkulturationsprozesse geprägt wurde. Kennzeichnend ist überdies ihre große Vielfalt von Religionen und Kulturen, die bis in das 20. Jahrhundert hinein bestand. Diese Region wird als eine komplexe, miteinander verwobene Entität verstanden. Mit dem nördlichen Schwarzmeerraum soll jedoch nur der Teil in den Blick genommen werden, der heute primär slawisch besiedelt ist. Dieser Bereich gehört im Wesentlichen zu der seit 1991 unabhängigen Ukraine und umfasst vor allen Dingen die ehemalige zarische Verwaltungseinheit Novorossija (ohne das zeitweilig damit gemeinsam verwaltete Bessarabien) sowie die Halbinsel Krim, einschließlich der sich anschließenden nördlichen Gebiete. Zudem soll das Gebiet, das u.a. von Skythen, Sarmaten, Griechen, Römern, Goten, Hunnen und Chazaren, Italienern, Tataren und Ostslawen bewohnt wurde, in größere Zusammenhänge eingeordnet werden.

Dem Mittelalter war eine Trennung von weltlichem und geistlichem Recht fremd. Es gab einen einheitlichen Rechtsbegriff, der religiös-metaphysisch begründet wurde. Die Geschichte des neuzeitlichen Rechts ist somit auch die Geschichte der Verweltlichung von Recht. Bedeutung erlangen dabei rezipiertes römisches Recht und Naturrecht. Der neuzeitliche Staat stützt sich auf religiös nicht abgeleitetes Recht, das so eine neue Funktion für die Legitimation des Staates erhält. Gleichzeitig wandeln sich Ausbildung und Berufsbild der Juristen. Die universitäre Juristenausbildung erhält einen neuen Stellenwert. Die Universitäten, die europäische Besiedelung Amerikas und die Französische Revolution werden zu Schrittmachern des kulturellen Transfers von Recht.

In the history of land, different dimensions overlap which are, strictly speaking, not interdependent. Land was simultaneously sovereign territory, the basis of agricultural production, a repository of mineral resources, a space to be accessed or travelled across, the object of expert knowledge and science, and the property of a state or private persons. The different rationales connected with these various perspectives resulted in numerous conflicts which became ever more difficult to resolve due to the increasing pace of change in most of these areas from the 19th century onward. If one views modern history "from below" in this way, it becomes a history of the mobilization of land.

Jahrhunderts als einer der Kernprozesse der Verwestlichung Japans, die auf der politischen und wirtschaftlichen Ebene relativ reibungslos erfolgte. Der vorliegende Artikel stellt den Rezeptionsvorgang in seiner Anfangsphase dar, analysiert seine Hintergründe und Voraussetzungen, Medien und Methoden sowie seine Akteure. Schließlich wird nach den Folgen des Transfers gefragt.

In der Geschichte des Bodens überlappen sich unterschiedliche Dimensionen, die per se unabhängig voneinander sind. Boden war gleichzeitig Hoheitsgebiet, Grundlage agrarischer Produktion, Reservoir von Bodenschätzen, Betretungs- und Verkehrsobjekt, Gegenstand von Expertenwissen und Wissenschaft sowie Eigentum von Staat oder Privatpersonen. Die jeweils spezifischen Logiken, die sich mit diesen Dimensionen des Bodens verbanden, sorgten für zahlreiche Konflikte, die umso schwieriger zu lösen waren, als sich in den meisten Feldern seit dem 19. Jahrhundert eine wachsende Dynamik entwickelte. Wenn man die moderne Geschichte in diesem Sinne "von unten" sieht, ist sie auch die Geschichte einer Mobilisierung des Bodens.

In den letzten Jahren des 19. Jahrhunderts erschütterte die sogenannte Dreyfus-Affäre nicht nur Frankreich, sondern zog auch in anderen europäischen Ländern, vor allem aber im Deutschen Reich, lebhafte Reaktionen nach sich. Ausgelöst wurde die Affäre 1894 durch die willkürliche Verurteilung des französischen Hauptmanns Alfred Dreyfus wegen Hochverrats (zugunsten des Deutschen Reichs) und dessen Deportation auf die vor Französisch-Guyana gelegene "Teufelsinsel". Obwohl sich bald berechtigte Zweifel an seiner Schuld regten, beharrten die französische Armee und das Kriegsministerium auf dem Urteil, bis Emile Zola im Januar 1898 mit einem "Offenen Brief" an den Präsidenten der Republik das Interesse der Öffentlichkeit erregte. Mit einem in der Tageszeitung L'Aurore veröffentlichten Artikel unter dem Titel "J'accuse!" klagte Zola einerseits die Militärhierarchie der Fälschung an, den Kriegsminister und den Präsidenten der Republik beschuldigte er andererseits, diese Manipulationen gedeckt zu haben. Die Veröffentlichung seines "J'accuse!" gilt als die Geburtsstunde des "engagierten Intellektuellen" moderner Prägung. In einer Zeit der Nationalismen und des aufkeimenden Antisemitismus (Dreyfus war als Jude und Elsässer für die französische Öffentlichkeit ein idealer Sündenbock) wurde die Dreyfus-Affäre auch zu einem beachtlichen Medienereignis.

During the transition from early-modern societies to the nation states of the 19th and 20th centuries, the formation of the territorial state performed an important function. The combining of dominions to form a geographical and political unit could occur through the annexation of the weaker territory by the stronger one, but it could also occur with the mutual agreement of the political decision-makers of both territories. In the case of a union, a distinction emerged very early on between a real union and a personal union (or union of crowns). While in a real union agreements under international law were equally binding for both partners, the personal union assumed a special status, in which the person of the ruler was the only connection between the two states. However, this strictly legal definition only applied to the political institutions. Below the state level, there were forms of transfer that could give a personal union a special, transnational character. Academic opinion remains divided on the extent to which these connections, which are referred to using the term "composite statehood", constitute a Europe-wide development.

Im Kontext der neuzeitlichen Nationalbewegungen Südosteuropas standen kirchliche und staatliche Entwicklungen in einem Wechselspiel, wobei der national-staatlichen Emanzipation auch Selbständigkeit auf kirchlicher Ebene vorausgehen konnte. In Zuge der politischen Restrukturierung des Balkanraums evozierte das Fortschreiten nationalstaatlicher Einigungsprozesse vor allem bei Serben und Rumänen dann aber auch neue Integrationsprozesse auf kirchlicher Ebene. Die volle kirchliche Selbständigkeit (Autokephalie) wurde am Balkan von den im 19. und 20. Jahrhundert als Nationalkirchen reorganisierten orthodoxen Lokalkirchen durch direkte oder mittelbare Emanzipation aus der Jurisdiktion des Ökumenischen Patriarchats errungen. Der Preis für die Emanzipation aus Konstantinopler Hegemonie war ein umso größeres Abhängigkeitsverhältnis zu den neuen Nationalstaaten.

The concept of Oriental Despotism has shaped the European interpretation and representation of Asiatic governments and societies for many centuries. Its origins can be found in Aristotelian political philosophy. However, its meaning since then has evolved, not only due to the theoretical approach of different thinkers, but also to Europeans' experiences in confrontation with the Asiatic world. During the Age of Enlightenment, Oriental Despotism was a particularly important idea, especially for the writings of Montesquieu. Afterwards, it played a significant role in Hegel's thought as well as in Marx's writing when it turned towards the "Asiatic mode of production" theory. Finally, the concept reappeared both in Weber's thought and, in the 20th century, in Wittfogel's.

Der Beitrag rekonstruiert den Entwicklungsprozess des Kolonialrechts in Europa und setzt sich mit seiner Beziehung zum Völkerrecht auseinander. Voraussetzung für unabhängige juristische Überlegungen in Bezug auf das Kolonialwesen und die Entstehung einer neuen juristischen Disziplin war die Berliner Kongokonferenz (1884–1885). Hier wurden die Rechtstitel definiert, die die Besetzung Afrikas rechtfertigten, und hier reifte die Überzeugung heran, dass das grundlegende Anderssein des afrikanischen Kontinents und seiner Bewohner nach außergewöhnlichen Antworten verlangte. Das Kolonialrecht lieferte diese Antworten, zu denen das Völkerrecht und das Konsularrecht nicht länger im Stande zu sein schienen. Die besondere Lage in Afrika war von großer Wichtigkeit für das Gründungsabkommen des neuen Rechts, gleichzeitig wurde sie benutzt, um die juristischen Ungeheuerlichkeiten in den Kolonien, die zeitgleich mit der rationell-modernen Rechtsordnung des Mutterlandes existierten, zu legitimieren.

In diesem Artikel soll untersucht werden, wie sich die Gestaltung von Bündnissen und Verträgen angesichts der neuzeitlichen Entwicklungen innerhalb der europäischen Staatenordnung verändert hat. Grundsätzlich gründeten und gründen sich die europäischen internationalen Beziehungen immer auf ein "anarchisches" System gleichberechtigt miteinander konkurrierender souveräner Staaten. Die allmähliche Entwicklung völkerrechtlicher Konzepte seit der Renaissance aber und der Einfluss kultureller, politischer und sozialer Veränderungen haben mit der Zeit Verträge und Bündnisse begünstigt, die die europäische Politik Schritt für Schritt einer "konstitutionellen" Lösung nähergebracht haben, ohne dass sie sich dieser allerdings in vollem Umfang verschrieben hat.

Friedensprozesse prägen die politischen und gesellschaftlichen Transformationen im vormodernen Europa auf vielen Ebenen. Den Kern dieser Friedensprozesse bildet das Aushandeln und Implementieren von Rechtsordnungen zur gewaltfreien Konfliktlösung und lässt sich vom sozialen Nahraum bis in die zwischenstaatlichen Beziehungen beobachten. Sie stehen in unmittelbarem Zusammenhang mit wechselseitig bedingten Kernprozessen der Vormoderne: Staatsbildung (Haus-, Stadt-, Landfrieden), Konfessionalisierung (Religionsfrieden) und Globalisierung (Diplomatie) mit je unterschiedlichen Formen der Normbildung und institutionalisierte Praktiken, die im Konfliktfall Kommunikation ermöglichen und zu rechtlich fixierten Regelungen führen sollen. Mit der Verankerung in der christlichen Friedensethik wie im gemeinen Recht sind diese Prozesse zugleich Gegenstand intensiver medialer, europaweiter Reflexion.

This article explores how the use of alliances and treaties changed along with the developments in the European international order in the modern era. Fundamentally, European international relations remained based on an "anarchic" system of competing sovereign states. Yet the evolution of concepts of international law from the Renaissance onwards and the impact of cultural, political, and social developments has encouraged a use of treaties and alliances that has moved European politics fitfully towards a "constitutional" solution, while never fully embracing such a model.

"Central and Eastern Europe" or "East Central Europe" in its usual sense encompasses the countries of Poland, the Czech Republic, Hungary, and Slovakia, which share certain historical commonalities and connections. Specifically, these were extraordinary – at least by European standards – ethnic and religious diversity, the geopolitical context between Germany and Russia, the involvement of the region in imperial contexts over a number of centuries, the subsequent emergence of independent nation states, as well as cultural transfers and concentrations. The term "East central Europe" is itself a source of much debate, as are the borders of the region which it refers to. In its broadest sense it also includes the Baltic states, Belarus, and Ukraine, as well as southeastern Europe and the Balkans, Brandenburg-Prussia and – for the second half of the 20th century – the German Democratic Republic (East Germany). However, the narrower concept of east central Europe referred to above remains the dominant one in the German-speaking countries.

Das Skandinavische oder auch Nordische Recht stellt einen eigenen Rechtskreis dar. For a decade now, the use of a transnational approach has profoundly renewed views of the history of the International Labour Organization (ILO). On the basis of recent research, this contribution proposes to shed light on some of the key elements of the history of the ILO and its permanent Secretariat, the International Labour Office (hereafter referred to as the Office). It also presents some lesser-known aspects, such as the emergence of technical cooperation in the wake of the 1929 economic crisis and the regionalization of ILO's activities in the 1930s – two trends that would gain in strength after 1945 and that make it possible to trace continuities in its history before and after the Second World War.

The League of Nations was the first international organisation to unite as many important fields as possible of human life under one roof. Yet, as well as standing for a number of innovations that smoothed the path for the work of the United Nations and established the League of Nations as a participant in the processes of globalisation, it embodies European rivalries, the continued existence of colonial structures, and the inviolability of national rights of sovereignty. This article sketches this double aspect of the League of Nations by portraying the significance of the League of Nations and the role of Europe.

Der Völkerbund war die erste internationale Organisation, die soziale, kulturelle, technische, wirtschaftliche, politische und militärische Kooperationen unter einem Dach bündelte. Allerdings gilt der Völkerbund als Symbol für die Janusköpfigkeit der Zwischenkriegszeit: Neben einer Vielzahl technischer, gesundheits- und sozialpolitischer Innovationen, die der Arbeit der Vereinten Nationen nach 1945 den Weg ebneten und den Völkerbund als Akteur in Globalisierungsprozessen auswiesen, steht er paradigmatisch für europäische Rivalitäten, das Fortbestehen kolonialer Strukturen und die Unantastbarkeit nationaler Souveränitätsrechte. Der Beitrag skizziert diese Vielgestaltigkeit und führt in die Bedeutung des Völkerbunds und in die Rolle Europas ein.

Das römische Recht und seine Quellen, vor allem die justinianische Kodifikation – das sogenannte Corpus Iuris Civilis –, haben die Rechtsentwicklung in Europa entscheidend geprägt und bildeten die Grundlage für viele europäische Rechtsordnungen. Untersucht wird daher auch die Rolle des römischen Rechts in der mittelalterlichen und neuzeitlichen Rechtswissenschaft. Zudem stellt dieser Beitrag die wechselseitige Beziehung des römischen mit dem kanonischen Recht und die Rezeption in vielen Ländern Europas vor.

Die verwandtschaftlichen Bande der europäischen Fürstenhäuser waren Teil einer spezifischen Technik des Machterhaltes. Um ihre Herrschaft zu sichern und auszuweiten, setzten die europäischen Dynastien auf Erbschaften und Heiraten sowie auf die Kommunikation und Kooperation mit Verwandten. So entstanden differenzierte Netzwerke mit vielfältigen sozialen, aber auch politischen Funktionen. Kulturtransfer zwischen vernetzten Dynastien war zwar keine von den Akteuren bewusst verfolgte Intention; dennoch brachte hochadelige Beziehungspflege Kontakte, Perzeptionen, Übernahmen und Lernprozesse zwischen weit voneinander entfernt lebenden Familien mit sich. Wegen dieser Effekte trug die Netzwerkbildung zur allmählichen Assimilation der eingebundenen Familien bei. Dynastische Verflechtung war ein vielseitiger, teilweise fragmentarischer und widersprüchlicher Faktor der Europäisierung.

This article discusses the historiography and methods of historical borderlands research, as well as research trends in this area. The first section describes development in this research area to date, as well as the historiography of borders and border regions, and it argues that the political events of 1989 and the significant reorientation in historical studies which followed it –concerning cultural history and microhistory, for example – promoted the emergence of borderlands research in the two decades after 1989. The second section gives an overview of the methodology, focusing on semantic aspects and various types and stages of borders. Discussing various historiographical questions and trends, the final section argues in favour of a transcultural approach to the study of borders in modern European historical research.

Die Dekolonisation ist eine zentrale, historische Entwicklungslinie, die in vier großen Phasen von 1776 bis 1991 mit der Freisetzung revolutionärer Kräfte das heutige Weltstaatensystem formte. Der Begriff der Dekolonisation beschreibt den Auflösungsprozess kolonialer Herrschaft in seinen verschiedenen politischen, wirtschaftlichen, kulturellen und gesellschaftlichen Dimensionen sowohl in der Peripherie als auch in der Metropole. Über 200 Jahre hat die Dekolonisation die Geschichte Europas mit der aller anderen vier Erdteile auf signifikante Weise verflochten und prägt bis heute das Verhältnis des europäischen Kontinents zur außereuropäischen Welt.

The kinship ties of Europe’s royal houses were part of a specific technique of maintaining power. To secure and extend their authority European dynasties made use of inheritance and marriages, as well as communication and cooperation among relatives. Their efforts yielded differentiated networks with myriad social and political functions. Although none of the aristocrats in question used their dynastic networks consciously to transfer culture, their cultivation of relationships nonetheless fostered contacts, perceptions, transfers and learning processes among families that lived far from one another. These effects in turn contributed to the creation of networks that supported gradual assimilation among the involved families. Dynastic interdependence was a complex, at times fragmentary and contradictory factor in the process of Europeanization.

Der Deutsche Rechtskreis bezeichnet das kontinentaleuropäische, deutschsprachige und typischerweise kodifizierte Recht, das von den Privatrechtsordnungen Österreichs, Deutschlands und der Schweiz dominiert wird. Deren Wurzeln liegen im römisch-deutschen Recht, das durch die Rechtswissenschaft im 19. Jahrhundert über die Grenzen Europas hinaus Auswirkungen auf andere Rechtskreise hatte. Die Wechselwirkungen zwischen den Kodifikationen des Deutschen Rechtskreises bewirken und bewahren deren Verbundenheit. Ihre Funktion als Rezeptionsgrundlagen oder als Modelle für die Rechtssysteme anderer Länder verleiht ihnen einen Einfluss, der die weltweite Bedeutung des Deutschen Rechtskreises unterstreicht.

Anhand des Netzwerks der armenischen Fernkaufleute von Neu Julfa (Iran) lässt sich beispielhaft die Entstehung und Entwicklung sowie die Struktur und Funktionsweise eines frühneuzeitlichen, diasporischen Handelsnetzwerks darstellen. Im 17. und in der ersten Hälfte des 18. Jahrhunderts traten die armenischen Kaufleute von Neu Julfa im südrussischen Astrachan' ebenso wie im indischen Surat, in Venedig, Manila oder Amsterdam als Mittler im globalen Austausch von Gütern, Menschen und Ideen auf. Zu ihrem bemerkenswerten merkantilen Erfolg trugen innere Faktoren ebenso bei wie äußere strukturelle und ereignisgeschichtliche Gegebenheiten an den Orten der Stütz- und Knotenpunkte dieses Handels- und Kommunikationsnetzwerks, das ganze Kontinente verband.

The emancipation of the Jews in Europe constitutes a historical process that lasted several centuries. Its roots reach back into the Age of Mercantilism and the Enlightenment but its completion in legal terms was only achieved in the late 19th century. Progress varied over time, depending on whether Sephardic or Ashkenazi communities were concerned, whether developed societal structures and an underlying liberal mood prevailed, as in the West, or agrarian-oriented forms with authoritarian governmental structures, as in the East. The emancipation of Jews was never completed in social terms.

Censorship as a means of controlling communication has existed since classical antiquity. However, it became significantly more important in the early modern period with the invention of printing, which enabled the easy reproduction of texts in large quantities. Initially, it was the church which imposed censorship, though institutions of the state soon became involved as well. In the 17th century, the campaign against censorship and for freedom of the press began in England, where substantial success was achieved as early as 1695. In France and Germany, on the other hand, freedom of the press was not achieved until (considerably) later. Temporary progress was repeatedly followed by backlashes. In the 20th century, the newly emerging media (film, radio, and television) also became subject to censorship and control measures, and modern totalitarian regimes engaged in the massive suppression of freedom of expression in these media. In European history, censorship was not only used as a means of political, intellectual and cultural control within the state, but was also used to prevent the cross-border transfer of information and ideas deemed unwelcome. Freedom of the press, on the other hand, opened the gates for transfer of this kind. However, a paradox existed in this regard: For a long time, state authorities allowed political newspapers to report on events abroad (indeed these reports formed a large part of the content) precisely because they distracted from domestic political circumstances.

Zensur als Mittel der Kommunikationskontrolle gab es schon in der Antike. Eine maßgebliche Bedeutung erhielt sie aber erst in der Frühen Neuzeit mit der Erfindung der Drucktechnik und der dadurch möglichen Vervielfältigung von Schriftwerken. Die Zensur ging zunächst von der Kirche aus, wurde dann aber auch von staatlichen Einrichtungen übernommen. Im 17. Jahrhundert begann der Kampf um Zensur- und Pressefreiheit in England, der 1695 bereits Früchte trug. In Frankreich und Deutschland konnte die Pressefreiheit dagegen erst (deutlich) später errungen werden. Auf zeitweilige Fortschritte folgten abermalige Rückschläge: Im 20. Jahrhundert wurden die neu hinzugetretenen Medien (Film, Rundfunk) ebenfalls Zensur- und Kontrollmaßnahmen unterworfen, und die modernen totalitären Regime betrieben massive Unterdrückung. Die Zensur diente in der europäischen Geschichte stets nicht nur der politischen und geistig-kulturellen Kontrolle nach innen, sondern sollte auch den grenzüberschreitenden Transfer unerwünschter Inhalte blockieren. Die Pressefreiheit hingegen öffnete solchem Transfer die Tore. Allerdings handelte es sich um eine paradoxe Gemengelage. Denn in den politischen Zeitungen dominierte (und tolerierte man) lange Zeit gerade die Auslandsberichterstattung, weil damit von inneren staatlichen Verhältnissen abgelenkt werden konnte.

Die Frage nach den externen Einflüssen auf das islamische Recht stellt sich in besonderer Weise für seine Entstehungsphase und für die Reformbewegungen der letzten zwei Jahrhunderte. In ihrer formativen Phase hat die islamische Rechtswissenschaft aus unterschiedlichen Quellen schöpfend ein beeindruckendes eigenständiges Rechtssystem geschaffen, dem man in vielen Fällen seinen Ursprung nicht mehr ansehen kann. Die seit dem 18. Jahrhundert entstandenen Reformbewegungen sind einerseits einem äußeren Anstoß durch Europa zu verdanken, konnten aber andererseits auch aus der eigenen Tradition schöpfen. Das im 19. und 20. Jahrhundert entstandene moderne islamische Recht ist jedoch in seiner Legitimierung wegen des westlichen Einflusses bis in jüngster Zeit einer Zerreißprobe ausgesetzt.

The question of external influences on Islamic law arises in particular with reference to the time it first emerged and to the reform movements of the last two centuries. During its formative phase Islamic jurisprudence drew on various sources, creating an impressive and quite independent legal system whose origins are in many cases not visible anymore. The reform movements, which started in the 18th century, were due on the one hand to external impulses from Europe, but could on the other hand also draw on native traditions. The emergence and development as well as the structure and functioning of an early modern diasporic trade network may be illustrated on the basis of the network of Armenian overseas merchants from New Julfa (Iran). In the 17th and in the first half of the 18th century, the Armenian merchants of New Julfa in Astrakhan in southern Russia, Surat in India, Venice, Manila, and Amsterdam appeared as mediators in the global exchange of goods, people, and ideas. Their remarkable mercantile success was due to internal factors as well as external structural and historical events at outposts and hubs of this trade and communication network that connected entire continents.

This article begins – drawing on research on imaginations of the Balkans – with a critical discussion of the representation of the Balkans as a border region, as this holds the danger of essentializing the Balkans as at least partially a non-European region. The question should instead be asked whether large regions are not border regions because different networks of interaction and communication overlap in them. The following depiction of the history of the Balkans region from about 1450 to 1950 thematizes on the one hand the integration of the region into broad contexts of interconnection (e.g. imperial contexts), and on the other hand the establishment of (new) borders in the Balkans and the societal consequences of these. A longue durée factor in the history of the Balkans was the central importance of external factors for historical developments in the region.

Die Emanzipation der Juden in Europa stellt sich als ein Jahrhunderte andauernder historischer Prozess dar, dessen Ursprünge in die Zeit des Merkantilismus und der Aufklärung zurückreichen und dessen Abschluss in rechtlicher Hinsicht zumeist im späten 19. Jahrhundert erreicht wurde. Es gab beträchtliche zeitliche Verschiebungen, je nachdem, ob sephardische oder aschkenasische Gemeinden betroffen waren, ob entwickelte gesellschaftliche Strukturen und eine liberale Grundstimmung, wie im Westen, oder agrarisch orientierte Formen mit autoritären Herrschaftsstrukturen, wie im Osten, vorherrschten. Gesellschaftlich wurde die Judenemanzipation nie zum Abschluss gebracht.

Beim Übergang von der frühneuzeitlichen Ständegesellschaft hin zu den Nationalstaaten des 19. und 20. Jahrhunderts kommt der Herausbildung eines geographisch und politisch definierten Territoriums, des Territorialstaats, eine wichtige Funktion zu. Ein Zusammenschluss von Herrschaftsgebieten zu einer geographisch-politischen Einheit konnte sich in Form der Annexion des Schwächeren durch den Stärkeren vollziehen, war aber auch im gegenseitigen Einverständnis der politischen Entscheidungsträger denkbar. Im Fall einer Union unterschied man bereits sehr früh zwischen den Typen der Realunion und der Personalunion. Während in einer Realunion völkerrechtliche Vereinbarungen für beide Partner gleichermaßen galten, nahm die Personalunion einen besonderen Status ein, in der allein die Person des Herrschers die Verbindung zwischen beiden Staaten darstellte. Diese streng juristische Definition galt jedoch lediglich für die politischen Institutionen. Jenseits der staatlichen Ebenen fanden sich Formen des Transfers, die einer Personalunion einen besonderen, transnationalen Charakter verleihen konnten. Inwiefern solche Verbindungen, die unter dem Begriff des "composite statehood" zusammengefasst werden, eine gesamteuropäische Entwicklung darstellten, bleibt innerhalb der Forschung umstritten.

Der deutsch-dänische Grenzraum gilt heute als europaweites Vorbild im Umgang mit nationalen Minderheiten und Musterbeispiel eines dauerhaften Grenzfriedens. Dies war nicht immer so. Erst die Bonn-Kopenhagener Erklärungen von 1955 schufen die dafür notwendigen nachhaltigen Voraussetzungen. Davor war der Grenzraum seit 1864 von schweren Spannungen und der gegenseitigen Ausgrenzung der nationalen Minderheiten geprägt. Diese setzten jeweils große Hoffnungen auf Grenzverschiebungen zu ihren Gunsten, was das gegenseitige Verhältnis nicht erleichterte. Zu Schlüsseldaten wurden einerseits das Jahr 1864, als Dänemark nach verlorenem Krieg Schleswig und Holstein an Preußen und Österreich abtreten musste, und andererseits das Jahr 1920, als die Bevölkerung Nordschleswigs bei einer Abstimmung über ihre staatliche Zugehörigkeit entweder zu Deutschland oder zu Dänemark zugunsten des letzteren votierte. Indes kann man eine Grenzziehung zwischen einem dänischen und einem fränkischen, später deutschen Machtbereich bis ins Jahr 811 zurückverfolgen. Dieser Grenzverlauf war zunächst aber sicher weitaus weniger linear und statisch, als es die seinerzeitige Orientierung an der Eider suggeriert und die nachfolgende Grenzrezeption glauben machen wollte. Vielmehr scheint die Vorstellung von einem breit angelegten Grenzsaum (engl. boundary oder border region) angemessen. Dieses Bild passt zumal für den deltaartigen Mündungsbereich der Eider mit seinen ausgedehnten, sumpfartigen Uferniederungen, der allein aus praktischen Gründen gar keine lineare Grenzziehung zuließ.

The doctrine of legal families seeks to establish common groups, identifying similar legal practices, activities and subject matter and thereby classifying the entirety of global legal transactions and activities into "families" according to particular criteria. The term "legal family" is employed in a number of different sub-disciplines of the legal sciences, but not always in identical fashion. The first attempts to establish such a division, made in the 19th century, were undertaken by those working in the field of comparative legal sciences but also by legal historians. The traditional and almost exclusive focus on the continental European and Anglo-American systems for so long dominant in this discipline later underwent a process of "globalization", incorporating extra-European law as a separate and independent subject of inquiry. The doctrine of legal systems has gradually developed a multiplicity of classifications which have themselves repeatedly become subject to debate in terms of their value and interaction and according to their "material-related" and "time-related" relevance. This process has seen the development of a whole range of new taxonomies, some of which have succeeded in displacing older, more established classifications.

Die Lehre von den Rechtskreisen versucht, die Gesamtheit des globalen Rechtsstoffes nach bestimmten Kriterien in größere Gruppen von Rechtsordnungen einzuteilen. Der Begriff des "Rechtskreises" wird von unterschiedlichen Teildisziplinen der Rechtswissenschaft verwendet, allerdings nicht immer gleichlaufend. Erste Versuche einer solchen Einteilung (seit dem 19. Jahrhundert) gingen von der Rechtsvergleichung, aber auch von der Rechtsgeschichte aus. Nachdem lange Zeit in erster Linie der kontinentaleuropäische und der angloamerikanische Rechtskreis im Blick der Forschung waren, wurde dieser "globalisiert" und außereuropäische Rechte als je eigener Untersuchungsgegenstand betrachtet. Insgesamt haben die Rechtskreislehren eine Vielfalt von Einteilungskriterien entwickelt, deren Wertigkeit in ihrem Zusammenwirken immer weiter diskutiert wird, mit je "materiebezogener" und "zeitbezogener" Relevanz. Neue Einteilungskriterien traten hinzu, andere fast völlig in den Hintergrund.

The medieval mind was unable to differentiate between temporal and spiritual law. Law was conceived as a unitary precept with a religious-metaphysical foundation. The history of modern law can therefore largely be written as an account of its secularization and de-sacralization, accompanied by the growing importance of Roman law and theories of natural law. The modern state is founded on an entirely non-religious legal corpus, which plays a new role in legitimizing the state. These changes to the laws and legal system entailed a change in the education and responsibilities of jurists; university-based legal training gained new significance. The universities, the European colonization of America and the French Revolution became the pace-makers in the cultural transfer of law.

This article reconstructs the development process of colonial law in Europe and discusses the relationship between colonial law and international law. The Berlin West Africa Conference (1884–1885) provided the basis for independent juridical thinking with regard to the colonial realm and for the emergence of a new juridical discipline. At this conference, the legal titles which justified the occupation of Africa were defined and the consensus emerged that the fundamentally different nature of the African continent and its inhabitants demanded extraordinary responses. Colonial law furnished these responses, which international law and consular law no longer seemed capable of providing. The special situation in Africa was of great importance for the establishment of the new law, while at the same time this special situation was used to legitimize the juridical monstrosities in the colonies, which existed simultaneously with the rational, modern legal system of the metropole.

Normen und Werte des neuen Staates wurden insbesondere in den Gründerjahren der Türkischen Republik gesetzt. Treibende Kraft hinter dem Nationalisierungs- und Staatsbildungsprozess der Türkei war der Kemalismus. Er war Produkt und Weiterentwicklung eines Nationalisierungsprozesses, der seine Wurzeln im Osmanischen Reich und den Ideen und Utopien aus Europa hatte. Aus diesen Ideen formten Atatürk und die türkische Staatselite ihre eigenen nationalen Vorstellungen und setzten diese im Kemalismus in politisches Handeln um. Der Kemalismus sollte die Transformation von Reich zu Republik vollziehen und den Islam als "gesellschaftlichen Kitt" durch einen starken türkischen Nationalismus ersetzen.

While in the 18th century enthusiasm for the liberal British constitution was a central element in continental Anglophilia, the American Revolution brought a new constitutional model. For many, the subsequent French Revolution was tainted by Jacobinism, explaining why European attention was focused on the democracy emerging in America in the 19th century. Many Europeans viewed the American model as an indication of what the future would bring. Great Britain, by contrast, took a different path to democracy, which attracted far less attention outside the country itself. It was only during the 20th century that both countries came to be viewed as archetypes of liberal western democracy.

The term "Reich" is found in a variety of European languages and has several applications in German. "Das Reich" is different, however, and it derives its suggestive force from a combination of secular and religious sources. This German "Reich" – or the Altes "Reich" as it is commonly referred to by modern historians in order to distinguish it from the German "Reich" of 1871 – played a central role in European history from the Middle Ages until its dissolution in 1806. Thereafter its legacy periodically continued to inspire and preoccupy groups of all political persuasions into the late 20th century.

Jahrhundert die Begeisterung für die freiheitliche englische Verfassung ein zentraler Bestandteil der kontinentalen Anglophilie war, entstand durch die amerikanische Revolution, mehr noch als durch die nachfolgende Französische, die für viele mit dem Odium des Jakobinismus behaftet blieb, ein neues Verfassungsmodell, das im 19. Jahrhundert aufgrund der sich dort entfaltenden Demokratie die Augen Europas nach Amerika lenkte. Galt nun der amerikanische Weg vielen als zukunftsweisend, vollzog sich in Großbritannien ein anderer Weg zur Demokratie, der außerhalb des Landes weit weniger Aufmerksamkeit erregte. Erst im Laufe des 20. Jahrhunderts galten beide Länder als exemplarische Verkörperung der liberalen westlichen Demokratie.

The term "enlightenment", as a noun or adjective, has been widely used by 20th-century historians to cover a multitude of ideas and activities in the 18th century, many of which were quite unknown to their contemporaries. The categories and taxonomies used by historians, and their normative allegiances, are not immune from revision, however, and use of the term may diminish as detailed contextual enquiries examine more carefully than hitherto the thought and action of the period. During the last two hundred years the meaning and implications of many familiar terms have changed greatly. There is no single tenet, practice or meaning to which everyone adhered, in different cultures, during the ‘enlightenment period’. Although many writers advocated sceptical enquiry into the nature of knowledge, nature, society and the human condition, few held that answers were to be found by the exercise of "reason alone"; and most were influenced, at least indirectly, by technological and scientific resources and understanding of the day.

This article deals with developments leading up to, the unfolding of and the outcome of the Greek War of Independence which began in 1821, while focusing in particular on the international dimension of the conflict. Just as diaspora communities in western and central Europe who had been influenced by the French Revolution of 1789 had played a central role in the emergence of the Greek nationalist movement, the insurrection itself also quickly became an international media event throughout Europe. It was the European great powers who ultimately rescued the rebellion (which was hopelessly divided and which had actually failed militarily) through largescale intervention and who put the seal on Greek sovereignty in 1830/32. The emergence of Greece as a European project between great power politics and philhellenism had a profound effect on the further development of the country.

It has traditionally been assumed that the influence of Islam on Western jurisprudence was far less than on natural sciences, philosophy and even theology. Since the Middle Ages, the development of a jurisprudence increasingly emancipated from theology, and the separate development of the two learned laws (Roman law and Canon law) have been among those characteristics of occidental society which clearly delimit it from the Islamic World. Nevertheless, Europe has an Islamic legal history as well. The influences of Islam on European legal history were on the one hand territorial: in those parts of Europe which were at some time in their history under Islamic rule, and on the other hand factual, especially – due to economic interests – in commercial law. Furthermore, there is an ongoing academic debate whether theoretical-methodological concepts were adopted as well.

International political networks became increasingly significant in Europe from the late-18th century onward. The parliamentarization of the system of government in an increasing number of countries provided the basis for this development, as it created direct competition between proponents of different basic political positions. The trend was also driven by media innovations such as the easier and quicker dissemination of news through printed newspapers, faster communication as a result of improved roads, new postal routes and, subsequently, railways and telegraphy, as well as the loosening of censorship restrictions in some countries. The structure of political networks reflected shifts in political debates and in power relationships, which in turn contributed to the restructuring of these networks. While cross-border political networks proved to be mutable and fragile, they became a projection surface for suspicions about secret structures.

Der seit 1948 mit der Schaffung der OEEC (Organisation für wirtschaftliche Zusammenarbeit und Entwicklung) in Gang gekommene reale Integrationsprozess war permanent von Diskussionen über Europakonzeptionen begleitet. Im Zentrum stand die Frage nach dem zwischenstaatlichen Föderalismus, im Gegensatz zum innerstaatlichen Föderalismus. Der folgende Beitrag geht dieser Entwicklung mit einem Fokus auf ihre ersten Jahrzehnte nach. Dabei wird sichtbar, dass jenseits der Diskussionen die reale Entwicklung eines staatenbundähnlichen Gebildes mehr und mehr bundesstaatliche Züge annahm und die Zukunft in allen Richtungen offen bleibt.

This article discusses concepts and realities of "borders" in early modern Europe. It outlines the basic shifts in the relevant terminology with particular emphasis on juridical and political discourses. It focuses on the relative importance of zonal and linear notions of borders, as well as on the growing significance of the natural environment in contemporary thought on the topic. The issue of inter-state relations, in particular as regards the Ottoman Empire, is used to illustrate the political relevance of changing concepts of borders.

The actual integration process that began with the creation of the OEEC (Organisation for European Economic Co-operation) in 1948 has constantly been accompanied by discussions about concepts of Europe. At the heart of these discussions was the question of federalism between states – as opposed to federalism within a state. This article investigates this debate with a focus on its early decades. Beyond these discussions, it becomes apparent that the actual development of a structure resembling a confederation of states has increasingly assumed aspects of a federal state and the future remains open in all directions.

Der deutsche Begriff "Reich" hat in mehrere europäische Sprachen Eingang gefunden, im Deutschen steht er für verschiedene Epochen und Herrschaftsverhältnisse. "Das Reich" dagegen bezieht seine suggestive Kraft aus einem Zusammenspiel von säkularen und religiösen Impulsen. Dieses deutsche Reich – eigentlich das "Heilige Römische Reich Deutscher Nation" oder auch das "Alte Reich", wie es in der modernen Geschichtswissenschaft zur Unterscheidung vom Deutschen Reich von 1871 häufig genannt wird – spielte in der europäischen Geschichte vom Mittelalter bis zu seiner Auflösung im Jahr 1806 eine zentrale Rolle. Die Diskussion um sein Erbe hat bis in die Gegenwart nicht aufgehört, die Wissenschaft zu beschäftigen.

In historical studies, the Black Sea region is viewed as a separate historical region which has been shaped in particular by vast migration and acculturation processes. Another prominent feature of the region's history is the great diversity of religions and cultures which existed there up to the 20th century. The region is understood as a complex interwoven entity. This article focuses on the northern Black Sea region, which in the present day is primarily inhabited by Slavic people. Most of this region currently belongs to Ukraine, which has been an independent state since 1991. It consists primarily of the former imperial Russian administrative province of Novorossiia (not including Bessarabia, which for a time was administered as part of Novorossiia) and the Crimean Peninsula, including the adjoining areas to the north. The article also discusses how the region, which has been inhabited by Scythians, Sarmatians, Greeks, Romans, Goths, Huns, Khazars, Italians, Tatars, East Slavs and others, fitted into broader geographical and political contexts.

Der Romanische Rechtskreis umfasst die Rechtsordnungen von Frankreich, Spanien, Italien, Belgien, Portugal, Rumänien und den Niederlanden. Zu seiner Herausbildung kam es im napoleonischen Zeitalter. Durch den "Code civil des Français" (1804) verbreitete sich das kodifizierte Recht in den französischsprachigen und/oder von Franzosen beherrschten Teilen der Welt. So sind unter anderem Rechtsordnungen in Lateinamerika stark von der napoleonischen Gesetzgebung beeinflusst. Zugleich vermittelten die Napoleonischen Kodifikationen die Ideen der Französischen Revolution und waren wegweisend für die Ausbildung freiheitlich-bürgerlicher politischer Denkrichtungen. Die Bedeutung, die die Napoleonischen Kodifikationen bis heute für den Romanischen Rechtskreis haben, kann deshalb nicht genug hervorgehoben werden.

Ähnlich wie bereits 1789 und nochmals 1848 gab im Juli des Jahres 1830 ein revolutionärer Umsturz in Paris das Signal für weitere Aufstandsbewegungen in anderen Ländern, die die europäische Staatenwelt bis zum Frühjahr 1831 erschuetterten. Bedingt, beeinflusst und begleitet wurden diese Aufstände durch einen intensiven Nachrichten- und Ideentransfer, durch die Reaktivierung eines revolutionären Symbolsystems und durch zahlreiche Bekundungen internationaler Solidarität. Damit konstituierte sich Europa in den Revolutionen der Jahre 1830/1831 als ein Kommunikations-, Erinnerungs- und Handlungsraum.

Dieser Beitrag beginnt – die Forschung über Imaginationen des Balkans aufgreifend – mit einer kritischen Diskussion der Repräsentation des Balkans als Grenzraum, da diese die Gefahr der Essentialisierung des Balkans als wenigstens partiell nichteuropäische Region beinhaltet. Vielmehr stellt sich die Frage, ob Großregionen nicht immer auch Grenzräume sind, da sich in ihnen unterschiedliche Netzwerke der Interaktion und Kommunikation überschneiden. Die anschließende komprimierte Darstellung der Geschichte des Balkanraums von ca. 1450 bis 1950 thematisiert einerseits die Einbettung der Region in weiterreichende Verflechtungszusammenhänge (z.B. imperiale Kontexte), andererseits die Etablierung (neuer) Grenzen am Balkan und deren gesellschaftliche Folgen. Ein longue-durée-Faktor in der Geschichte des Balkans ist dabei die zentrale Bedeutung von externen Faktoren für historische Weichenstellungen in der Region.

The Romance legal family refers to a group of countries (France, Spain, Italy, Belgium, Portugal, Romania and the Netherlands) whose legal systems and practices share certain common defining characteristics. Established during the expansion of France under Napoleon Bonaparte, codified French law in the form of the "Code civil des Français" (1804) was disseminated in French-speaking countries and throughout the sphere of French influence and rule. As a result, some of the legal systems found in Latin America exhibit a strong influence of Napoleonic legislation. The Napoleonic codifications also acted as agents of transfer for the ideas of the French Revolution and were an important stimulant for the growth of political Liberalism. The significance of the influence of the Napoleonic codifications on the subsequent nature and development of the Romance legal family cannot be over-stressed.

Similar to the earlier revolution in 1789 and the subsequent one in 1848, the revolutionary upheaval in Paris in July 1830 served as a signal for further revolutionary movements in other countries, which shook the European states to their foundations up to the spring of 1831. These rebellions were brought about, influenced and accompanied by an intensive transfer of news and ideas, by the reactivation of a system of revolutionary symbols and by numerous declarations of international solidarity. In this way, Europe emerged in the revolutions of 1830/1831 as a communicative space, and a space of memory and action.

Traditionellerweise wird davon ausgegangen, dass der Einfluss des Islam auf die westliche Rechtswissenschaft bei Weitem geringer war als auf Naturwissenschaften, Philosophie und selbst Theologie. Die Ausbildung einer sich von der Theologie emanzipierenden Rechtswissenschaft und die getrennte Entwicklung der beiden gelehrten Rechte gehören seit dem Mittelalter zu den Charakteristika der abendländischen Gesellschaft, die sie von der islamischen Welt grundlegend unterscheiden. Nichtsdestoweniger gibt es eine islamische Rechtsgeschichte Europas. In dieser zeigen sich einerseits territorial Einflüsse in zeitweise islamisch beherrschten Teilen Europas und andererseits sachlich – durch ökonomische Interessen bedingt – vor allem im Handelsrecht. Ob auch theoretisch-methodische Konzepte vom islamischen Recht übernommen wurden, ist derzeit Gegenstand eines wissenschaftlichen Diskurses.

Länderübergreifende politische Netzwerke gewannen seit dem ausgehenden 18. Jahrhundert in Europa an Bedeutung. Grundlage dafür war die Parlamentarisierung einer wachsenden Zahl von Regierungssystemen und damit die direkte Konkurrenz von Vertretern unterschiedlicher politischer Grundsatzpositionen. Dazu traten mediale Innovationen wie die leichtere Verbreitung von Nachrichten durch gedruckte Zeitungen, verkürzte Kommunikationswege durch bessere Straßen, Postverbindungen und später Eisenbahnen und Telegraphie sowie die Lockerung von Zensurbestimmungen in manchen Ländern. Die Struktur politischer Netzwerke reflektierte Verschiebungen in politischen Debatten und Machtverhältnissen, die wiederum dazu beitrugen, diese neu zu strukturieren. Obgleich sich grenzüberschreitende politische Netzwerke als wandelbar und fragil erwiesen, wurden sie zur Projektionsfläche von Vermutungen über geheime Strukturen.

Attempts to circumscribe our topic are naturally hampered by the fact that secrecy is a many-sided thing. The expression "secret societies" evokes a Wittgensteinian family resemblance of a great variety of organisations with all sorts of similarities, yet not a single feature common to all. As a result, most existing definitions are accompanied by abundant provisos, qualifications, and exceptions. For a historical survey, the easiest way to get a grasp of the subject is first to trace the history of the term. Then we shall look in turn at the two sides of the secret society: Its bringing together of men who are hiding something.

Der Artikel behandelt Vorgeschichte, Verlauf und Ausgang des griechischen Unabhängigkeitskrieges von 1821, wobei die internationale Dimension dieses Konflikts besonders berücksichtigt wird. Ging schon die Entstehung der griechischen Nationalbewegung maßgeblich auf west- und mitteleuropäische Diasporagemeinden zurück, die unter dem Eindruck der Französischen Revolution von 1789 standen, wurde auch die Erhebung selbst schnell zu einem internationalen Medienereignis von gesamteuropäischer Reichweite. Die europäischen Großmächte waren es schließlich, die den heillos zerstrittenen und militärisch eigentlich schon gescheiterten Aufstand durch massive Intervention retteten und 1830/32 die Souveränität beschlossen. Die Entstehung Griechenlands als europäischem Projekt zwischen Großmachtpolitik und Philhellenismus prägte die weitere Entwicklung des Landes maßgeblich.

Die grundlegenden Veränderungen in der relevanten Terminologie werden kurz skizziert, wobei rechtliche und politische Diskurse besondere Berücksichtigung finden. Der Stellenwert zonaler und linearer Grenzvorstellungen wird ebenso diskutiert wie die zunehmende Bedeutung natürlicher Gegebenheiten im zeitgenössischen Denken zu diesem Thema.
